The U.S. Supreme Court announced today that it will review Fifth Circuit court ruling and injunction that halted President Obama’s DAPA and expanded DACA programs. These programs offer protection against deportation and a work permit for potentially millions of people. The programs were enjoined by a Texas court, which held that the Administration should have instituted the programs only after “notice and comment” under the Administrative Procedure Act. The Texas court’s decision was upheld in a split decision by a panel of the Fifth Circuit Court of Appeals. The Supreme Court will review that decision in April, 2016. A favorable decision may allow the DAPA and expanded DACA programs to take effect before the end of President Obama’s term.
